As a parent, you want to ensure that every product you use to care for your baby is safe. This includes items like the crib, bassinet, changing table, decor, high chair, and car seat. Sadly, every year many products are recalled, some of which are exclusively used for infants and toddlers. Some product recalls are voluntary, but others are the result of severe injury or death of a small child. The Consumer Product Safety Commission releases statistics on product defects every year. Still, parents should not have to worry about the products they bring home for their baby. If you or a loved one has been injured by a defective product, please contact the attorneys at Rocky Mountain Personal Injury Center to discuss your options and learn more about Manufacturer Liability for Product Defects.
Product Recalls in 2020
This past year alone, there were several major product recalls. Infantino recalled a baby carrier due to faulty straps. Costway issued a voluntary recall for its strollers due to a risk of entrapment, falling, or strangulation. Ikea issued another recall for its children’s furniture due to the risk that it could topple over onto a child. Several small children died in recent years due to toppling furniture.
If your TV, nightstand, or dresser was purchased with an anti-tip kit, install it yourself or hire a professional. Also inspect any product you purchase for material or cosmetic defects. If you are unsure of how to install the product, call the manufacturer’s customer service line or hire a furniture installer. Products liability cases are weakened if a contributing factor to the plaintiff’s injury was negligence or frustration of purpose on the part of the plaintiff. Similarly, using a product for another reason or method than it was intended ]will usually void the UCC warranty of merchantability and the warranty of fitness for a specific purpose.
Next Steps After an Injury
If you or a loved one was injured, seek medical care immediately. If someone you know suffered a fatality, it might be necessary to request an autopsy so that cause of death is on the record. As a plaintiff, we would work with your medical providers to obtain records relevant to your injuries. You should also keep the defective product in storage as evidence for your case, as well as a copy of any item receipts or warranties. You would also be eligible for damages due to lost wages, job loss, future lost wages, property damage, emotional distress, pain and suffering, future medical costs, and additional damages. While infant injuries are rare, it can be extremely traumatizing for the child, parents, and loved ones. As consumers, we should not have to worry about every product we introduce into our home.
